Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter the “Terms”) govern the purchase of products on the kiding.it website, operated by KIDING SRL. Before placing an order, please read these Terms carefully. By completing an order, you confirm that you have read, understood and fully accepted them.

2. Scope

These Terms apply to all purchases made through the kiding.it website by consumers (natural persons acting for purposes outside their business, commercial, craft or professional activity) and by business customers. The term “consumer” has the meaning given in Article 3 of Italian Legislative Decree No. 206/2005 (Italian Consumer Code).

KIDING SRL reserves the right to amend these Terms at any time. Amendments apply to orders placed after the date on which the updated version is published.

3. Products and Prices

The products available on kiding.it are described with their technical features, materials and images. Images are for illustrative purposes only and may differ slightly from the actual product due to photographic rendering.

Prices are shown in euros and include applicable VAT. KIDING SRL reserves the right to change prices at any time; however, the buyer will be charged the price shown at the time the order is confirmed.

In the event of an obvious pricing error (e.g. a clearly incorrect price due to a technical fault), KIDING SRL reserves the right to cancel the order and will promptly notify the customer.

4. Purchase Process and Conclusion of the Contract

The purchase process on kiding.it works as follows:

The user selects products and adds them to the basket.
The user proceeds to checkout and enters their shipping and billing details.
The user chooses a payment method and completes the order.
The user receives an order confirmation email, which constitutes acceptance of the purchase offer.

The sales contract is deemed concluded when KIDING SRL sends the order confirmation by email. KIDING SRL reserves the right not to accept orders if a product is unavailable, if there are payment irregularities or for other justified reasons. In such cases, the customer will be promptly notified and any amount already paid will be refunded in full.

Once an order has been placed, it cannot be changed or cancelled. If necessary, please contact us promptly at hello@kiding.it: we will assess each case individually, depending on the processing status of the order.

5. Payments

Kiding.it accepts the following payment methods:

Credit and debit cards (Visa, Mastercard, American Express)
Apple Pay and Google Pay
PayPal
Any other methods enabled through Shopify Payments

All payments are processed securely through Shopify Payments, a PCI-DSS Level 1 certified platform. KIDING SRL has no access to the buyer’s credit card details, which are processed exclusively by the payment provider.

Payment is charged when the order is confirmed. If payment is not authorised, the order will not be processed and the customer will be notified by email.

6. Shipping and Delivery

Shipping is governed by the Shipping Policy available on kiding.it, which forms an integral part of these Terms. In summary:

Order processing: within 1 business day, Monday to Friday.
Delivery to Italy: 24–72 business hours. Carriers: GLS, BRT. Cost: €6.00 (free on orders of €50 or more).
Delivery to the EU: 48–72 business hours. Carrier: DHL Express. Cost: €10.00 (free on orders of €50 or more).
Express delivery in Italy on request: contact hello@kiding.it before placing your order.

Delivery times are estimates and are not guaranteed. KIDING SRL is not liable for delays attributable to carriers, force majeure or peak periods.

7. Right of Withdrawal and Returns

Consumers have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason. Returns are free of charge. The full procedure is described in the Returns and Refunds Policy available on kiding.it, which forms an integral part of these Terms.

Refunds are issued within 14 days of receipt of the returned product, once its condition has been checked, using the same payment method used for the purchase.

The right of withdrawal does not apply to personalised products or to products sealed for hygiene reasons which have been unsealed after delivery (Article 59 of Italian Legislative Decree No. 206/2005).

8. Legal Guarantee of Conformity

All products are covered by the 2-year Legal Guarantee of Conformity from the date of delivery, pursuant to Italian Legislative Decree No. 206/2005 as amended by Legislative Decree No. 170/2021. The full procedure and available remedies are described in the Legal Guarantee Policy available on kiding.it.

9. Liability and Limitations

KIDING SRL shall not be liable for:

Indirect or consequential damage or loss of profit arising from use of the products contrary to the instructions for use.
Delivery delays attributable to carriers or to force majeure (extreme weather events, strikes, pandemics, natural disasters).
Temporary malfunctions of the kiding.it website due to technical issues or maintenance.
The content of third-party websites accessible via links on kiding.it.

In any event, the liability of KIDING SRL towards consumers is limited to the value of the product purchased, except in cases of wilful misconduct or gross negligence.

10. Intellectual Property

All content on kiding.it — including texts, images, logos, graphics, product names, trademarks and any other material — is the exclusive property of KIDING SRL or used under licence. Any reproduction, distribution or commercial use without the prior written authorisation of KIDING SRL is prohibited.

The Kiding® trademark and its logo are registered trademarks of KIDING SRL. Unauthorised use constitutes an infringement of intellectual property rights.

11. Reviews and User Content

Customers may share reviews of the products they have purchased and of their experience with Kiding. Reviews may be published on the website together with the name or form of identification chosen by the user.

Content that is unlawful, offensive, defamatory, off-topic or that contains third parties’ personal data is not permitted. KIDING SRL reserves the right to moderate content within the limits permitted by applicable law.

12. Privacy and Data Processing

The processing of personal data collected during the purchase is governed by the Privacy Policy available on kiding.it, drawn up in accordance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree No. 196/2003. By completing an order, the buyer confirms that they have read the Privacy Policy.

13. Dispute Resolution

These Terms are governed by Italian law. Disputes with consumers are subject to the provisions of Italian Legislative Decree No. 206/2005 (Italian Consumer Code).

Consumers resident in the EU have the right to use the European Commission’s ODR (Online Dispute Resolution) platform for the out-of-court settlement of disputes: ec.europa.eu/consumers/odr.

Alternatively, consumers may apply to the competent mediation and conciliation bodies pursuant to Italian Legislative Decree No. 28/2010.

For disputes with business customers, the Court of Forlì-Cesena shall have exclusive jurisdiction.

14. Changes to the Terms

KIDING SRL reserves the right to amend these Terms at any time. The updated version is always available on kiding.it, showing the date of the last change. Changes do not apply to orders that have already been confirmed.
